South Carolina State Ethics Committee To Hold Secret Meeting To Silence Opposition To Obamacare

The following is a letter I recently sent to various Representatives of the people of the State of South Carolina.  It would seem that South Carolina is trying to bring in secret trials to stop any discussion or opposition against the Affordable Care Act, also known as Obamacare.


Earlier this year, State Rep. Bill Chumley stood up against ObamaCare and introduced a strong nullification bill to protect our state.  Tuesday, the House Ethics Committee met in Executive Session -- the public was not allowed at the meeting.

They had planned to discuss Rep. Bill Chumley.  But Rep. Chumley requested a public hearing.

I find this behavior unacceptable, and highly reminiscent of Nazi Germany, Stalinist Russia, and Mao Tsetung's China.

House Ethics Committee attorney Emma Dean, prior to Williams flying to Columbia, issued a written opinion to Rep. Chumley that it was NOT a violation of state ethics laws to use the state plane to bring in a witness for a subcommittee hearing.

She wrote: “Therefore, it is the opinion of the Ethics Committee staff that you would not be committing a violation of the South Carolina Ethics Act by requesting the state plane be used to transport a witness to a subcommittee meeting.”

The House Ethics Committee determined, against the opinion of their own lawyer, that Rep. Chumley’s request to use the state plane to fly expert witness Walter Williams, a George Mason University economics professor, to testify at a subcommittee hearing on nullification of ObamaCare was somehow campaigning.

Could you explain to me how a REQUEST TO USE THE STATE PLANE to fly a witness in to testify in a case is a violation of the South Carolina Ethics Act?  The House Ethics Committee's behavior suggests that they stand to make a great deal of money by the passage of the Affordable Care Act, a.k.a. Obamacare.

In a 2-1 decision, the U.S Court of Appeals for the Third Circuit ruled Delaware’s secret arbitrations in business disputes is unconstitutional.

The ruling upholds a lower court decision that found the arbitrations should be public. Under Delaware’s legal system, disputes had to involve at least one business as a party in the dispute, with at least $1 million that were contested as part of the dispute.

This trial, not on the official Statehouse website’s schedule of meetings, is scheduled for Monday, December 23rd, in room 110 of the Blatt Building, at 9:30a.m.  As you know, many people are going on Christmas vacation at this time, choosing rather to concentrate on spending time with family and friends rather than paying attention to the business of the South Carolina state government.

It is my assertion that the House Ethics Committee not only is trying to hold this trial as retaliation for Rep. Chumley's standing against Obamacare, but that this trial, which is an arbitration in that it is not going through the court system, is an attempt to silence any and all dissent against an illegal and immoral piece of legislation.

As a citizen of the state of South Carolina, I am asking you to do everything in your power to stop this trial before it starts.  The fact that the Ethics Committee would hold a trial in secret in order to avoid public scrutiny is evidence of an oligarchy, which is defined as a small governing group: a small group of people who together govern a nation or control an organization, often for their own purposes.

If you cannot, or will not, whatever the case may be, bring prosecution against the State Ethics Committee for this, then you should still do everything possible to stop this trial.  The rights of the citizens of the State of South Carolina are being stripped away by this behavior.  If they can do it to a Representative, then they can do it to an average citizen.  And if they are allowed to do this, then they will surely become a court in and of themselves, arresting and prosecuting people they disagree with as they see fit.

Remember, if the South Carolina State Ethics Committee gets away with this, your state may be next, if it's not already a victim.
