Fw: BREAKING: Major First Amendment Victory



Not only a win for life but for free speech as well.

For almost half a century, Roe v. Wade covered up the stark, grim reality of abortion under the counterfeit guise of constitutional righteousness.

Even now, with Roe dispatched to the junk yard of history, radical abortion activists are going to extreme lengths to protect the illusion that killing unborn children is "healthcare."

Which is why I'm so excited to tell you about a victory we've just won in Texas, not only a win for life but for free speech as well.

You see, back in 2020, Mark Lee Dickson, Director of Right to Life of East Texas and founder of Sanctuary Cities for the Unborn Initiative, posted on social media accusing three pro-abortion groups of participating in the "murder of innocent unborn human beings."

For too many Americans saturated by our abortion culture, this posting came as a shock. After all, abortion was not only legal, it was supposed to be and touted as a constitutional right!

Three groups, The Lilith Fund for Reproductive Equity, the Afiya Center, and Texas Equal Access Fund, were especially upset with Mark's words, and the organizations sued him for defamation – libelous falsehood – in two separate lawsuits.

Keep in mind, Mark did not make any claims that these pro-abortion groups had actually been convicted of any crimes.

But Mark's charge was factually truthful, because a Texas law prohibiting abortions, enacted before Roe v. Wade, had never been repealed and was still in Texas's statute books.

The federal judiciary has no authority to erase statutes that it declares unconstitutional. It may only declare and order them unenforceable.

Fast forward to this year when these two defamation lawsuits – which we've been defending together with former Texas Solicitor General Jonathan Mitchell – have made it all the way up to the Texas Supreme Court.

And I'm pleased to tell you that the Court has just ruled that Mark Dickson's speech calling abortion murder was 100% protected by the First Amendment!

Mark's speech expressed his opinion – shared by millions of pro-lifers in Texas and elsewhere, including Texas legislators who never repealed its condemnation of abortion as murder.

Mark lawfully spoke out in good faith to protect the lives of unborn babies, and this Texas Supreme Court victory fully vindicates his right to do that.

Victories like this prove that we must keep fighting – and courageously speaking out! – for what's right, and if we do so, the truth will prevail.

I'll leave you with Mark's own inspiring words about his case:

"Pro-life truth in Texas has been set free. I hope that every organization that promotes abortion gets out of the baby-murdering business entirely."
